IRS Fresh Start Program, Atlanta Attorney

Unfortunately, even successful self-employed professionals and business owners in Atlanta fall behind on federal taxes. Legal guidance can lower your risk of Internal Revenue Service (IRS) collection efforts.

The team at The Gartzman Law Firm, P.C., handles income tax controversies and solutions for taxpayers. Our lawyers have helped Georgians manage tax issues for over 40 years. Contact us today to discuss whether the IRS Fresh Start Program is the right solution for your situation.

What Is The IRS Fresh Start Program?

The IRS Fresh Start initiative is a set of expanded policies that make it easier to resolve back taxes and avoid aggressive collection actions. It raised the threshold for when the IRS files a federal tax lien and created more flexible rules for resolving an existing lien. In many cases, taxpayers who enter a qualifying payment plan or meet specific criteria may request tax lien withdrawal, removing the lien from the public record.

Fresh Start also broadened access to installment agreements, allowing taxpayers to pay over time through manageable monthly payments. It expanded eligibility for an offer in compromise, which may let you settle tax debt for less than the full amount when paying in full would create financial hardship.

Although not part of Fresh Start itself, penalty abatement can reduce your balance by removing certain penalties if you qualify based on reasonable cause or compliance history. If your financial situation prevents any payment, the IRS may place your account in Currently Not Collectible status, temporarily pausing collection efforts.

Who Qualifies For The IRS Fresh Start Program?

Taxpayers with a total tax debt of $50,000 or less may be eligible for Fresh Start if they filed required tax returns and are not currently pursuing bankruptcy. You also need to be current on any estimated tax payments and demonstrate that financial hardship prevents you from paying the full amount at once.
